The litigation rate is just a measure of the change in the number of cases,
which Hensler says is a modest 3% after adjustment of population growth (p.
6). Litigiousness is the tendency of people to take matters to the courts.
Hensler says in order to measure it, other information such as "whether the
number of claims or grievances that could be litigated was growing."
For example, if one person is bitten by a dog, and just goes to a doctor
for treatment, and if another goes to an attorney plus a doctor, the second
person is more litigious.
