Seeing as how every insurer authorized to transact workers' compensation
insurance in this here state is required by law to be a member of a
licensed rating org (NCCI is still the only one, at least as of 9:04
a.m. this morning), and to report all its lovely statistical data
thereto,
and seeing as how you conjured your marvelous new table under the
oversight of a committee of your members,
and seeing as how this table is now subject to review by regulators all
across the land, and probably by independent bureaus for submission to
their fair states as well,
and seeing as how the several editions of "Table M" have been openly
presented in actuarial literature and discussed at length at CAS and
other professional forums over the vast majority of this rapidly aging
century,...
(pausing to take a breath here....)
Seeing all that, your claim to intellectual property seems a little
weak. The CAS, the industry, your paying customers, regulators (your
real 'customers'), and who-knows-who-all may well take umbrage at your
assertion.
I will continue to ask in public forums I attend whether NCCI actuaries
will be allowed to publish and present their research. So far, the
answer I have always gotten is that NCCI will encourage you to do so. I
have serious doubts as to whether or not representatives of the several
rating organizations understand the question.
This topic is appropriate for CasNet chatter because if your Table is to
be available only to your paying customers, I can see that trend of
thinking resulting in a CAS exam syllabus with material unobtainable to
many students and us left with nothing to talk about at CAS meetings and
seminars. I would hope the CAS Board has at least had some informal
discussion of this prospect.
Back to NCCI, I am waiting for a response to my request for a more
complete derivation of your new Table — which might very well become
public information — and an explanation of just what is a "Large Account
affiliate" given the membership requirements of Oregon law.
